So many critical issues in play during a divorce

There are so many different issues that could be at play in any given divorce, that it is hard to predict exactly how any individual divorce case will proceed. The only thing you can know is that there are myriad variables and numerous different ways that they could play out. For this reason, and it is one of many reasons, it is imperative for the divorcing spouses to consult with an attorney. Without one, they put themselves at great risk.

Consider any of the following:

  • Do you have children? Then child custody and child support will be two critical issues that you need to deal with. What will the custody schedule look like? How will visitation be handled? What are your child support payments, and what should you do in case your ex-spouse fails to pay?
  • Have you been awarded alimony (spousal support)? Tracking these payments is an important issue, and much like child support payments, you need to be prepared for nonpayments.
  • Did you and your spouse have a prenuptial agreement or a postnuptial agreement? This will dictate a lot of what happens in the divorce, but you should still have a legal advocate on your side.
  • Property division and other critical matters in a divorce will be very difficult for someone to handle on their own.
